Welcome to Mark for Nebraska and www.markfornebraska.org. Mark for Nebraska (“Mark for Nebraska,” “we,” “us,” or “our”) is the principal campaign committee for Mark Cohen, and maintains this site to share information about Mark’s campaign for the U.S. House of Representatives in Nebraska’s 3rd Congressional District, and to give supporters a way to volunteer, donate, sign up for updates, and contact the campaign. These Terms of Use govern your use of this site, so please read them carefully.
This site is for informational and campaign-organizing purposes only. By using this site you acknowledge that you have read these Terms of Use and that you accept them, as we may modify them from time to time. When we make a modification, we will post a revised version of these Terms of Use on this site. Changes take effect when posted. We are not required to provide notification that we have made a change, so please review these Terms of Use periodically. Your continued use of the site indicates your agreement to any change. We reserve the right to add to, remove, change, or terminate access to any of the content or functions of the site without specific notice. You may not alter site content in any way. “Mark for Nebraska” and “We’re Smarter Than They Think” are slogans and trademarks of the Mark for Nebraska campaign.
2. Donations and Campaign Finance Compliance
By contributing through this site, you certify that: (a) you are a U.S. citizen or lawfully admitted permanent resident; (b) you are at least 18 years old; (c) the contribution is made from your own funds and not those of another person; (d) the contribution is not made from the funds of a corporation, labor organization, federal government contractor, or foreign national; and (e) you are not reimbursing or being reimbursed by anyone for the contribution. Federal law requires us to collect and report the name, mailing address, occupation, and employer of contributors whose aggregate contributions exceed $200 in an election cycle. The Federal Election Commission then makes that information publicly available. Contributions to Mark for Nebraska are not tax-deductible for federal income tax purposes.

9. Venue, Waiver of Jury, and Attorney’s Fees
In any legal action arising out of your use of this site, you agree that the exclusive venue shall be in the District Court of Keith County, Nebraska, or, if federal jurisdiction is mandatory, in the U.S. District Court for the District of Nebraska. You waive trial by jury in any action arising out of your use of this site.
10. Governing Law
Nebraska law governs these Terms of Use and any issues arising out of them or out of your use of this site, without regard to conflict-of-laws principles.
11. Severability
If a court holds any clause or provision of these Terms of Use invalid in whole or in part, the remaining clauses and provisions remain in full force and effect. The court shall revise the invalid term in favor of Mark for Nebraska to the maximum extent the law allows.
12. Captions
The captions of each section are for convenience only and have no effect on the construction of any provision of these Terms of Use.
13. Waiver
Failure to insist upon strict compliance with any of the terms, covenants, and conditions of these Terms of Use does not waive those terms, covenants, and conditions. No waiver of any right or power under these Terms of Use is valid unless in writing and signed by an authorized representative of Mark for Nebraska.
